The Collapse of the 28-Clause Peace Proposal for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe felt a moment of respite on Monday, as the diplomatic emergency caused by the presentation of a new 28-article proposal for ending the war appeared – temporarily – to have been defused. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of aerial bombardment on Kyiv.

The Cycle of Peace Talks and Military Action

The chain of conflicting incidents captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: optimistic declarations are released from various governments. Considerable effort is devoted on managing particular approaches. By night, Russian leadership brutally reminds the world that, for them, conflict continues to be the main instrument for achieving "peace".

Nocturnal Warfare

As the offensive developed into the early hours of Tuesday, the current condition of Ukraine's vulnerability was exposed. Ukraine is capable of detecting missile launches from Russian territory, a capability provided through current data. From observation points, defense planes that had been deployed to counter approaching aerial threats roared overhead – advanced fighter aircraft delivered to Ukraine by NATO members.

Moments later, Kyiv's anti-aircraft weapons activated: several firings fired to intercept a hostile projectile. This was a modern interception technology at work, probably delivered by allied countries. Every deployment jolts you unexpectedly, causing tremors. The moment of terror quickly becomes sober acceptance: perhaps the approaching threat won't strike its target this time, protecting urban areas from catastrophe and further power outages.

Ongoing Risks

Not long after, a large-caliber weapon fired at a drone close by, part of a mobile-fire group – most likely allied-provided weaponry. Unfortunately, the shots failed to hit the enemy aircraft – it pressed on overhead toward its objective.

Intermittently, this continued until dawn. Kyiv awoke to the daybreak reports: several casualties, devastation and utility failures in numerous residences as a result of the nocturnal offensive. As typically, everyone still went about their day – living the war. But those full day encapsulated Ukraine's vital need on external assistance – a dependence that regional partners are clearly incapable to replace in the short term.

Unsuccessful Negotiations

The comprehensive proposal from US administration provoked deep reactions, debate and serious worry – and temporarily diverted attention from Ukraine's largest corruption scandal in years. Yet, we have experienced comparable situations, after prior negotiation attempts and international summits.

Every new initiative from Washington follows the same pattern: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They contain the crisis but never actually achieve victory. This trend will, no doubt, endure.

Tactical Assessments

It is convenient to criticize specific actors of repeatedly advocating Moscow's conditions. But that does not seem to be the entire situation. US administration functions according to a assumption well known to experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The White House presumes that it is unrealistic to compel Moscow to abandon the territory that it presently holds in Ukraine's southern or eastern regions.

The problem is that while accepting these circumstances, Washington does little to prevent Kremlin actions, through words or deeds, from thinking that the situation will not change more in its advantage in the coming year.

Opposing Positions

Therefore, the Kremlin is convinced that the clock favors them – that Ukraine and its partners are nearing depletion. Their reason to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to stop fighting, but they will continue as long as Russia's leadership remains supremely confident in the result.

On the contrary, Ukraine's government believes that Ukraine can still persist, slowly losing people and territory but averting a entire defensive failure until conditions improve in its favour.

Current Realities

Factually, there are no genuine requirements for a ceasefire. Now, subjective factors are entering the equation: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the flag against any proposal Kyiv finds unworkable, so that their attention does not move to homefront challenges. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a just a single week to eliminate the proposed articles of the most recent proposal. Forceful and unpredictable management of the matter by American leadership, opposition by Ukraine and the remaining European nations, along with calming attempts of representatives, and finally, recent disclosures, all achieved their purpose.

While new initiatives based on established approaches are approaching, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and show particular unwillingness to modify developments, if they stand together and strengthen their defence capabilities at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capability to repel nightly air assaults will, for the predictable period, largely rely on continued Western support.
